Debt collection for utilities in a cottage residential area

The court found the requirements of the managing organization of the cottage village to recover the debt for utilities from the owner of the land plot justified.

We were contacted by a management company, which manages a cottage village with a request to assist in recovering from one of the owners of a land plot located in the territory of the village debt for utilities.

The matter was complicated by the lack of direct legislative regulation of disputed relations.

In court, we proved that the relations of the content of common property of a cottage village by a management company are subject, by analogy, to the application of the law on horticultural, vegetable garden and country non-profit associations of citizens that regulate the maintenance of public property of a country non-profit association of citizens.

The result of the dispute was the complete satisfaction of the requirements of the management company.
