The dispute over the legality of building construction

Solomon Law Firm defended the property of the leasing company from gratuitous seizure.

The Solomon Law Firm defended the property of the leasing company from gratuitous seizure of non-residential premises in the court of appeal. Earlier, the Arbitration Court of the Novosibirsk Region recognized a part of the premises owned by the leasing company as community property.

Lawyers at Solomon Law Firm, who entered the case at the appeal stage, have proven that the disputed premises are not common property. The main thesis of defense was the fact that each of the owners of the building owns a separate building with an independent entrance, not functionally connected with other buildings. Therefore, premises located in one of the blocks of the building cannot be shared by the owners of neighboring blocks of the building. These arguments were supported by the Seventh Arbitration Court of Appeal, which quashed the decision of the trial court on October 30, 2017.
